New Jersey cannabis laws: the basics every adult should know

Who can buy, where you can and can't use cannabis, and why it has to stay in New Jersey: the essentials in plain English.

New Jersey voters approved adult-use cannabis in 2020, and licensed dispensaries began adult-use sales in 2022. If you're new to it, the rules are simpler than you might think. Here are the basics every adult in New Jersey should know.

Who can buy

Adults 21 and older can buy cannabis from a licensed dispensary. You'll need a valid, unexpired government-issued photo ID every time you shop, and dispensaries check it for every guest.

Where to buy

Buy only from dispensaries licensed by the New Jersey Cannabis Regulatory Commission (CRC). Licensed products are tested and labeled under state rules, so you know what you're getting. Dispensaries also follow state limits on how much can be bought in one visit; your budtender can explain these at the counter.

Where you can use it

Using cannabis in public places isn't allowed. That includes streets, parks, parking lots and other public spaces. Many landlords and workplaces have their own policies too. The safest choice is to enjoy cannabis at home.

Driving

Driving under the influence of cannabis is illegal in New Jersey, just like driving under the influence of alcohol. Never drive or operate machinery after use. Plan a ride, or wait until you're completely sober.

Crossing state lines

Cannabis is still controlled under federal law, so taking it across state lines is against the law, even into a neighboring state where cannabis is also legal, such as New York. Keep it in New Jersey.

Keeping it safe at home

  • Store products in their original, child-resistant packaging.
  • Keep them locked away from children, pets and visitors under 21.
  • Never share cannabis with anyone under 21.
